Former Apple Employee Sued for Leaking iPhone’s Journal App & More

Earlier this month, Apple sued one of its former employees Andrew Aude in California State Court, alleging that the former employee has breached the company’s confidentiality agreement and violated labor laws by leaking confidential and sensitive information to the media and employees at other tech companies. The company is claiming a jury trial and asking for damages in excess of 25,000 USD.

Role of the former employee

Andrew Aude joined Apple fresh out of college as an iOS software engineer in 2016. His role was optimizing battery performance, which made him privy to information about dozens of Apple’s most sensitive projects, the complaint claims.

What has Aude leaked?

The lawsuit claims that for five years, the employee used his Apple-issued work iPhone to leak information about more than a half-dozen Apple products and policies. It includes the then-unannounced Journal app and Vision Pro headset, along with product development policies, strategies for regulatory compliance, employee headcounts, and much more.

Apple claims that in April 2023, Aude leaked a list of final features for the iPhone’s Journal App to a journalist at Wall Street Journal via a Phone call. The proof was seen later that month as the journalist Aaron Tilley published an article called “Apple Plans iPhone Journaling App in Expansion of Health Initiatives”.

Aude has been accused of using the encrypted messaging app Signal to send over 1400 messages to the same reporter whom he called ‘Homeboy’. He has sent over 10,000 texts to another journalist at the website The Information and the complaint claims, that Aude traveled across the continent to meet her.

In October 2020, Aude disclosed the company’s development of products within spatial computing space to a non-Apple employee. Over the next few months, he continued to share confidential information about unannounced products and hardware with outsiders.

Apple’s Complaint

Apple believes that whatever Aude has done is on purpose and Aude has allegedly accepted that he leaked the information to kill products and features with which he had problems. Apple claims that these leaks led to at least five news articles with information that was confidential and proprietary.

Apple learned about Aude’s wrongful deeds in late 2023 and fired him for misconduct in December 2023. In a November 2023 interview, Aude claimed that he didn’t leak any information, but during that interview, he then to the bathroom and deleted a significant amount of evidence from the work iPhone (which includes the Signal app that was used to communicate with Homeboy).

Although he did accept some part of the misconduct in December 2023, that wasn’t enough. Apple tried to sort the matter out of court but Aude was uncooperative. Reportedly, he has also refused to divest the restricted Apple stock units that he received as part of his compensation package.

The main reason behind the lawsuit is that Apple believes Aude is an ongoing threat to the company due to his long and extensive history of leaking information to 3rd parties without authorization, his relations with individuals at other companies and journalists, and his attempts to conceal misconduct.

Apple is now seeking compensatory as well as punitive damages in an amount to be determined during the trial. The company is also seeking other legal remedies.
