The recent decision given by the Kerala High Court has opened up new ways of dealing with many issues plaguing road safety in the state. In its lengthy order, the court has clearly stated its strong opinion against many points such as the modification of vehicles without permit, the LED lights on buses for advertising, the act of vlogging while travelling in a vehicle standing on a road.
Kerala High Court’s New Rule
The Division Bench of the Kerala High Court comprising of Hon’ble Justice Anil K. Narendran and Hon’ble Justice Harisankar V Menon emphasized on the serious issue pertaining to modifications of motor vehicles made without authorization. These include modified exhaust systems besides unapproved lights whereby such changes do not only violate existing safety measures but also exacerbate pollution thereby become a real threat to personal and public health.
Among all the violation points recorded, by far the most worrying for the court is the violation that involves vlogging from the car’s driver cabin since it is unlawful to drive the vehicle while recording at the same time. Through laying emphasis on this problem in advance, the court seeks to reduce chances occurring of accidents and encourage safe road use among drivers.

This order could be considered an elaboration of how serious these offenses are under Section 190(2) of the Motor Vehicles Act, which opens up possibilities for disqualification of driving licenses for offenders. Further, another issue that has emerged relates to the use of government department name boards as well as emblems on vehicles where the court has stated that this is prohibited unless it is done under the authorization of the officials.
The content has also expanded to cover cars imported under Carnet where the authorities have been ordered to uphold standards of safety, pollution, ad noise reduction. The severity of the consequences for these violations does not spare vehicles either as license can be revoked or suspended to support the court’s stance on road safety provisions.
As a result of these directions, the enforcement department has been deployed to collect videos of such incidents in the social media platforms in order to lead to the attribution and subsequent sanctioning of the delinquents. Furthermore, the court has demonstrated its sincerity to stop the authorization or continuation of the modified cars on the roads by stressing the need to cancel or suspend the registration of these cars, while highlighting the need for standard and safer road environment to be maintained and enhanced respectively.
